Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", the "Customer") and Yanib ("Yanib", "we", "us"). They govern your access to and use of the Yanib service available at yanib.dev and any related websites, APIs, SDKs, embeds, and integrations (collectively, the "Service"). Please read these Terms carefully along with our Privacy Policy and Refund Policy, which are incorporated by reference.

1. Acceptance of terms

By creating an account, accessing, or using the Service you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" in these Terms refers to that organisation. If you do not agree to these Terms, do not use the Service.

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.

2. Description of service

Yanib is an AI-powered release notes platform that connects to your GitHub or GitLab repositories, generates structured changelogs from your commits and pull or merge requests, and distributes them to configured integrations including Slack, Discord, email, webhooks, and public changelog pages.

The Service also provides team velocity digests, developer profiles, embeddable SDK components, and a public REST API. We may add, modify, or remove features at any time; material changes will be communicated as set out in Section 14.

3. Accounts and access

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately at support@yanib.dev of any unauthorised access or suspected breach.

You may sign in using GitHub, GitLab, Google, or email. By connecting a third-party account, you grant us permission to access the data described in our Privacy Policy and authorise us to act on your behalf within the scope of the OAuth permissions you granted.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Abuse, harass, threaten, defame, or infringe the rights of any person.
  • Upload, generate, or distribute content that is illegal, infringes intellectual property, or violates third-party rights.
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or our underlying systems.
  • Interfere with, disrupt, or place an unreasonable load on the Service infrastructure.
  • Scrape or bulk-download data from the Service beyond documented API rate limits.
  • Use the Service to distribute malware, phishing content, or spam.
  • Resell, sublicense, or provide the Service to third parties as a hosted offering without our prior written permission.
  • Use the Service to develop a competing product or to benchmark it for a competing product.
  • Use the Service in any way that violates applicable export-control or sanctions laws.

We may investigate suspected violations and may suspend or terminate access where we reasonably believe a violation has occurred.

5. Intellectual property

Your content. You retain all rights to your code, commit messages, pull/merge request descriptions, and any content you create or upload ("Customer Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, and process Customer Content solely as necessary to provide the Service to you and to comply with law.

AI-generated output. Changelogs, summaries, social posts, and digest narratives produced by the Service from your input are derivative of your input data. As between you and Yanib, you own the generated output and may use it freely. AI output may be inaccurate or incomplete; you are responsible for reviewing it before publishing.

Our service. The Yanib platform, brand, logos, software, APIs, and documentation are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. No other rights are granted.

Feedback. If you send us suggestions or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free licence to use it without obligation to you.

6. Plans and billing

Yanib offers a Free plan and paid plans (currently "Pro"). The Free plan is limited to one connected repository. Paid plan features and current prices are listed on our Pricing page.

Merchant of Record. All paid subscriptions are sold and billed by Paddle.com Market Limited ("Paddle"), our authorised reseller and Merchant of Record. Paddle is responsible for processing your payment, managing the customer-facing payment relationship, calculating and remitting any applicable VAT, GST, or sales tax, and handling refund disbursement. Paddle's customer terms apply to the payment transaction in addition to these Terms.

Auto-renewal. Paid plans renew automatically at the end of each billing period at the then-current price unless cancelled. You can cancel auto-renewal at any time from Settings → Billing; cancellation takes effect at the end of the current paid period and you keep access until then.

Refunds. Refund eligibility is set out in our Refund Policy, including a 14-day money-back guarantee on first-time purchases.

Price changes. We may change prices with at least 30 days' notice. Existing subscriptions will continue at their current price until the next renewal after the notice period.

Failed payments. If a renewal payment fails, we (via Paddle) will attempt to recharge for a reasonable period. If payment cannot be collected, paid features will be paused and your account may be downgraded to Free.

7. Third-party services

The Service interoperates with third-party services such as GitHub, GitLab, Anthropic, Slack, Discord, Resend, and Paddle. Your use of those services is governed by the third party's terms and privacy notice. We are not responsible for the availability or behaviour of third-party services and disclaim liability arising from their actions or outages to the maximum extent permitted by law.

If you use the Bring Your Own Key (BYOK) feature with your own AI provider key, you are responsible for your own usage costs and compliance with that provider's terms.

8. Service availability

We strive for high availability but do not guarantee uninterrupted access. The Service depends on third-party providers (including GitHub, GitLab, Anthropic, Paddle, and Vercel) and their availability. We are not liable for downtime caused by such providers, by scheduled maintenance, or by causes beyond our reasonable control.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND SECURITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, FREE FROM DATA LOSS OR CORRUPTION, OR SECURE AGAINST UNAUTHORISED ACCESS, AND WE DO NOT WARRANT THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PURPOSE. YOU ARE RESPONSIBLE FOR REVIEWING AI OUTPUT BEFORE PUBLISHING IT AND FOR MAINTAINING YOUR OWN BACKUPS OF ANY CONTENT YOU CONSIDER CRITICAL. NOTHING IN THESE TERMS LIMITS WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YANIB AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION, OR BUSINESS OPPORTUNITY, ARISING FROM OR IN CONNECTION WITH THE SERVICE — INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM (i) SERVICE INTERRUPTIONS, BUGS, OR ERRORS; (ii) THE LOSS, CORRUPTION, OR UNAUTHORISED DISCLOSURE OF DATA; (iii) SECURITY INCIDENTS OR UNAUTHORISED ACCESS TO YOUR ACCOUNT OR DATA; (iv) INACCURATE OR INAPPROPRIATE AI-GENERATED CONTENT, OR THE PUBLICATION OR DISTRIBUTION OF SUCH CONTENT TO THIRD-PARTY CHANNELS (SLACK, DISCORD, EMAIL, WEBHOOKS, GITHUB, ETC.); OR (v) ACTS OR OMISSIONS OF THIRD-PARTY SERVICE PROVIDERS.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE — REGARDLESS OF THE FORM OF ACTION (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) — WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO YANIB IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$25.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded by law (such as liability for fraud, gross negligence, wilful misconduct, death, or personal injury caused by negligence) or any non-waivable statutory rights you may have as a consumer.

11. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Yanib and its affiliates from and against any third-party claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) your Customer Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your infringement of any third-party right.

12. Termination

You may delete your account at any time from the Settings page. We may suspend or terminate your access if you breach these Terms, present a security or legal risk, or fail to pay amounts due, with notice when reasonably feasible.

Upon termination, your right to use the Service ends immediately and your data will be deleted in accordance with our Privacy Policy (typically within 30 days, subject to legal retention obligations). Sections that by their nature should survive termination (including Sections 5, 9, 10, 11, 13, and 15) will survive.

13. DMCA / copyright complaints

If you believe content hosted via the Service infringes your copyright, send a DMCA-compliant notice to support@yanib.dev including: (i) identification of the copyrighted work; (ii) identification of the allegedly infringing material with sufficient detail to locate it; (iii) your contact information; (iv) a statement that you have a good-faith belief the use is not authorised; (v) a statement, under penalty of perjury, that the information is accurate and you are authorised to act; and (vi) your physical or electronic signature. We will respond to valid notices and may terminate repeat infringers.

14. Changes to terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect, unless a shorter period is required by law. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

15. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Utah, USA, without regard to its conflict-of-law principles. The competent courts of Salt Lake County, Utah have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that you may also bring claims in your country of residence where required by mandatory consumer law.

Before filing a formal claim, both parties agree to attempt in good faith to resolve any dispute by contacting support@yanib.dev.

Nothing in this Section affects mandatory consumer rights you have under the laws of your country of residence.

16. Force majeure

Neither party will be liable for failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, internet or utility outages, or failures of third-party providers.

17. Miscellaneous

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Yanib regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
